When you create a Herald account, we collect your name, email address, phone number, and restaurant name. When you connect third-party services, we receive read-only access to your POS sales data, labor reports, review platform data, and delivery platform earnings. We collect usage data such as login times and feature interactions to improve the service. We do not collect payment information directly — all billing is handled securely by Stripe.
Your data is used exclusively to: generate your daily briefing, power your Herald dashboard, send you alerts and notifications you have configured, and improve Herald's accuracy and performance. We do not sell your data. We do not share it with third parties for advertising purposes. We do not use your business data to train AI models.
We share your data only with the following service providers who help us operate Herald: Anthropic (AI processing), Twilio (SMS delivery), SendGrid (email delivery), Supabase (database hosting), and Stripe (payment processing). Each provider is bound by their own privacy policies and data processing agreements. We do not share your data with any other third parties without your explicit consent.
All third-party integrations use OAuth 2.0 or API key authentication — we never store your POS login credentials. All data is encrypted in transit using TLS 1.3 and encrypted at rest using AES-256. Access to your data is restricted to Herald systems and staff on a need-to-know basis.
We retain your data for as long as your account is active. If you cancel your account, your data is permanently deleted within 30 days. You may request immediate deletion at any time by contacting support@heraldbriefing.com. You can also export all your data at any time from your Settings page.
You have the right to access, correct, export, or delete any personal data we hold about you. If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what data we collect and the right to opt out of data sales (we do not sell data). Herald uses only essential session cookies required to keep you logged in. We do not use tracking cookies, advertising cookies, or third-party analytics cookies.
Herald is not intended for use by anyone under the age of 18. We do not knowingly collect personal data from minors.
We may update this Privacy Policy from time to time. We will notify you of significant changes by email. Continued use of Herald after changes constitutes your acceptance of the updated policy.

By creating an account or using Herald in any way, you agree to be bound by these Terms of Service. If you do not agree, do not use Herald. We may update these Terms from time to time — continued use after changes constitutes your acceptance of the updated Terms.
Herald provides a daily operational briefing service for independent restaurant and bar owners. All insights, recommendations, and AI-generated content are informational only and do not constitute professional business, financial, legal, or accounting advice. You are solely responsible for all business decisions made based on Herald's output.
You must be at least 18 years old to use Herald. You are responsible for maintaining the security of your login credentials and for all activity under your account. You must be the owner or authorized operator of the restaurant or bar you register. You may not register on behalf of a business you do not own or operate without explicit authorization.
Herald is billed monthly at the rates displayed at signup. Your 7-day free trial begins on the date of account creation. After the trial, your payment method will be charged automatically each month. You may cancel at any time from your Settings page — cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months. All prices are in USD.
You agree not to: (a) use Herald for any unlawful purpose; (b) attempt to gain unauthorized access to Herald's systems or data; (c) use automated tools to scrape, copy, or extract Herald's content, algorithms, or interface; (d) resell or sublicense access to Herald without written permission; (e) impersonate any person or entity or misrepresent your affiliation with any person or entity.
Herald's software, design, algorithms, briefing methodology, AI prompts, brand identity, and all associated intellectual property are the exclusive property of Herald and are protected by United States copyright law. You may not: (a) copy, reproduce, modify, or create derivative works of Herald's interface, code, or methodology; (b) use Herald's output, structure, or methodology to build, design, or inform a competing product or service; (c) reverse engineer, decompile, or attempt to extract Herald's source code or underlying algorithms; (d) use Herald's brand, name, logo, or trade dress in any manner without written permission. Violation of this section may result in immediate account termination and legal action.
By connecting third-party services such as your POS system, review platforms, or delivery platforms, you authorize Herald to access and process data from those services solely for the purpose of generating your briefings and dashboard. You represent that you have the right to grant this access. Herald does not sell your data or use it to train AI models.
Herald is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or timeliness of any briefing or dashboard data. To the maximum extent permitted by law, Herald's total liability to you for any claims arising from your use of the service shall not exceed the amount you paid to Herald in the three months preceding the claim.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time from your Settings page. Upon termination, your data will be deleted within 30 days.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Hidalgo County, Texas.
